These Terms of Service ("Terms") govern your access to and use of the mobile games, applications, websites, and related services provided by VFK INVESTMENT L.L.C ("VFK", "Hiroba Games", "we", "us", or "our") under the Hiroba Games brand that link to or reference these Terms (collectively, the "Services").
Please read these Terms carefully before using the Services. By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
These Terms apply to all games, applications, websites, and related services published or operated by VFK INVESTMENT L.L.C under the Hiroba Games brand, unless separate terms are provided for a specific product.

Our games are intended for a general audience. Some of our games may be suitable for users aged 6 and older depending on the applicable app store age rating, but our Services are not directed specifically to children under the age of 13 unless expressly stated otherwise.
Parents and legal guardians are responsible for the use of the Services by minors under their care, including any in-app purchases or activity made through their device, platform account, or payment method.
4. License to Use the Services

5. App Stores, Platforms, and Third-Party Terms
If you download, access, or use our games through Apple App Store, Google Play, Apple Game Center, Google Play Games Services, or any other third-party platform, your use of the Services may also be subject to that platform's terms, rules, and policies.
The applicable platform provider may process payments, manage refunds, provide platform services, provide account or leaderboard features, and enforce its own rules according to its own terms and privacy policy.
In the event of a conflict between these Terms and the applicable platform terms, the platform terms may apply to the extent required by that platform or applicable law.
For Apple App Store users, Apple and its subsidiaries may be third-party beneficiaries of these Terms to the extent required by Apple's applicable terms, and may have the right to enforce these Terms against you in that capacity.

The Services and all content included in or made available through the Services are owned by VFK, Hiroba Games, or their licensors.

game mechanics and systems
characters
visual assets
2D and 3D models
animations
environments and levels
user interface designs
icons and logos
trademarks
sounds and music
text and artwork
game data
features
virtual items
virtual currency
documentation
promotional materials
You may not copy, modify, distribute, sell, rent, license, reverse engineer, decompile, disassemble, extract, or otherwise exploit any part of the Services unless expressly permitted by applicable law or by written permission from VFK.
7. User Accounts, Guest Use, and Platform Accounts
Our games generally do not require users to create a Hiroba Games account. You may be able to use our games as a guest user or through platform services.
Where available, certain features may allow you to use Apple Game Center, Google Play Games Services, Sign in with Apple, Google Sign-In, or similar platform services. Your use of those services is subject to the relevant platform provider's terms and privacy policy.
You are responsible for keeping your device, platform account, login credentials, and payment methods secure.
You are responsible for all activity that occurs through your device or platform account, including purchases made by minors or other users who access the Services through your device or account.
8. Leaderboards, Nicknames, and Public Display
Some of our games may include leaderboard or scoreboard features.
If a game includes a leaderboard or scoreboard feature, your nickname, display name, platform profile name, score, ranking, and related gameplay performance information may be visible to other users.
If you choose or enter a nickname, you must not use offensive, misleading, infringing, unlawful, or inappropriate names, and you should not use your real name or include personal information in your nickname.
We may remove or reset leaderboard entries, scores, nicknames, or rankings if we reasonably believe they violate these Terms, involve cheating, are inaccurate, or harm the Services or other users.
9. Acceptable Use
You agree that you will not:
use the Services for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose
use cheats, bots, hacks, mods, automation software, exploits, or unauthorized third-party software to modify or interfere with the Services
reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except where expressly permitted by applicable law
modify or tamper with game files, game data, builds, client software, or server communication
access or attempt to access systems, servers, accounts, or data that you are not authorized to access
interfere with, disrupt, overload, or damage the Services or any servers or networks connected to the Services
exploit bugs, errors, or unintended mechanics in a way that harms the Services or other users
bypass security, payment, anti-cheat, advertising, analytics, consent, or access control systems
use the Services to upload, transmit, or distribute malware, spyware, harmful code, or unauthorized scripts
impersonate VFK, Hiroba Games, our employees, partners, or any other person or entity
infringe the intellectual property, privacy, publicity, or other rights of VFK, Hiroba Games, or any third party
sell, rent, transfer, trade, sublicense, or commercially exploit access to the Services, virtual items, or virtual currency unless expressly allowed by us
use the Services for gambling, betting, wagering, or similar activities
use the Services in violation of applicable export control, sanctions, anti-money laundering, consumer protection, or other laws
We reserve the right to determine whether conduct violates these Terms or the intended spirit of the Services.
10. Updates, Changes, and Availability
The Services may change over time. We may update, modify, balance, patch, suspend, remove, or discontinue any part of the Services at any time, subject to applicable law.
This may include changes to gameplay features, levels, progression systems, rewards, virtual items, virtual currency, advertisements, events, pricing, app availability, supported devices, and technical requirements.
You may need to update the Services or your device software to continue using the Services.
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
11. Advertisements
The Services may include advertisements from us or third-party advertising partners.
Advertisements may be personalized or non-personalized depending on your device settings, region, consent choices, and applicable law.
We are not responsible for third-party advertisements, websites, products, or services that may appear in or be linked from the Services.
12. In-App Purchases
The Services may offer in-app purchases, including remove-ads options, virtual currency, virtual items, decorations, premium features, boosters, packs, or other digital content.
In-app purchases are processed by the applicable platform provider, such as Apple App Store or Google Play. We do not directly process or store your full payment card details.
You agree to pay all fees, charges, and applicable taxes related to purchases made through your device or platform account.
All purchase transactions are subject to the terms, payment rules, refund policies, and billing systems of the applicable platform provider.
If a purchase is restorable under platform rules, we will make reasonable efforts to support restoration of the relevant entitlement where technically possible and required by the applicable platform.
13. Virtual Currency and Virtual Items
Virtual currency, virtual items, digital content, and other in-game benefits are licensed to you, not sold.
Virtual currency means in-game currency such as coins, gems, cash, energy, or similar digital units that may be earned, purchased, or used within our games.
Virtual items means digital items or content available in our games, such as decorations, buildings, skins, boosters, content packs, cosmetic items, or similar in-game content.
You receive a limited, personal, non-transferable, non-sublicensable, revocable right to use virtual currency, virtual items, and digital content within the Services, subject to these Terms.
Virtual currency and virtual items:
have no real-world monetary value
cannot be exchanged for real money
cannot be transferred outside the Services
cannot be sold, traded, rented, gifted, or assigned unless expressly permitted by us
may be modified, balanced, limited, suspended, removed, or discontinued where permitted by applicable law
We may manage, regulate, modify, or remove virtual currency, virtual items, features, or digital content to maintain game balance, improve the Services, prevent abuse, comply with legal requirements, or support product changes.
If a game offers mechanisms to receive randomized virtual items from a purchase, we will disclose the applicable odds or probability information where required by applicable law or platform policy.
14. Refunds
Refunds for in-app purchases are handled by the platform through which the purchase was made, such as Apple App Store or Google Play.
Except where required by applicable law or the relevant platform policy, purchases of digital content, virtual currency, virtual items, and in-app features are final and non-refundable once delivered, consumed, or used.
If you believe there has been an unauthorized or incorrect purchase, you should contact the relevant platform provider. You may also contact us at support@hirobagames.com, and we may assist where reasonably possible.
15. Subscriptions
We do not currently offer subscriptions in our games. If a Service offers subscriptions in the future, the subscription terms, price, duration, renewal, cancellation, and refund rules will be displayed before purchase and will be subject to the relevant platform provider's rules.
Deleting an app may not cancel a subscription. If subscriptions are introduced, subscriptions must be cancelled through the relevant platform account settings unless otherwise stated by the applicable platform.
16. User Content and Feedback
Our games do not currently allow users to publicly upload or share user-generated content such as chat messages, profile photos, public posts, custom images, or uploaded files, unless a specific game states otherwise.
If we introduce features that allow user-generated content in the future, we may update these Terms or provide additional rules.
If you send us feedback, suggestions, ideas, bug reports, feature requests, or other comments, you grant VFK, Hiroba Games, and their affiliates a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable right to use, copy, modify, publish, distribute, and otherwise exploit that feedback for any purpose, without compensation to you, to the extent permitted by applicable law.
17. Third-Party Services and Links
The Services may include or link to third-party services, websites, advertisements, software development kits, analytics tools, platform services, or other external content.
We do not control and are not responsible for third-party services, their content, their terms, or their privacy practices.
Your use of third-party services may be subject to their own terms and privacy policies.
17.1 Unreal Engine and Licensed Technology
The Services may be developed using Unreal® Engine and other technology licensed from Epic Games, Inc. and its affiliates (collectively, the “Licensed Technology”).
Epic Games, Inc. and its affiliates are not parties to these Terms and make no representations or warranties regarding the Services.
To the maximum extent permitted by applicable law, all representations, warranties, conditions, and liabilities relating to the Licensed Technology are expressly disclaimed.
Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States of America and elsewhere.
18. Suspension and Termination
We may suspend, restrict, or terminate your access to all or part of the Services if we reasonably believe that:
you violated these Terms
your activity creates legal risk for us or others
your activity harms the Services, our users, our partners, or our systems
your activity involves fraud, abuse, cheating, unauthorized access, or illegal conduct
we are required to do so by law, platform rules, or a competent authority
we discontinue the Services or any part of them
If your access is suspended or terminated, you may lose access to game progress, virtual currency, virtual items, purchases, leaderboard entries, or other content associated with the Services, except where applicable law or platform rules require otherwise.
You may stop using the Services at any time by deleting the relevant app from your device.
19. Discontinuation of the Services
We may stop offering or supporting the Services, or any specific game, feature, platform, or region, at any time, subject to applicable law and platform rules.
If we discontinue a game or feature, your license to use that game or feature will end when the discontinuation becomes effective.
We are not required to provide refunds, compensation, or replacement content for discontinued services, except where required by applicable law or platform policy.
20. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an 'as is' and 'as available' basis.
We do not make any warranties, express or implied, regarding the Services, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or error-free operation.
We do not guarantee that:
the Services will always be available
the Services will be uninterrupted or error-free
defects will be corrected
the Services will be free of viruses or harmful components
the Services will meet your expectations
game progress, virtual currency, virtual items, purchases, leaderboard entries, or data will always be preserved
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.
21. Limitation of Liability
To the maximum extent permitted by applicable law, VFK INVESTMENT L.L.C, Hiroba Games, and their directors, officers, employees, contractors, partners, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages for loss of profits, loss of data, loss of goodwill, business interruption, device issues, loss of virtual currency, loss of virtual items, loss of purchases, loss of leaderboard ranking, loss of game progress, or other intangible losses arising out of or related to your use of the Services.
To the maximum extent permitted by applicable law, our total liability for any claim related to the Services will not exceed the amount you paid to us through the Services in the six months before the claim arose, or, if you paid nothing, the minimum amount permitted by applicable law.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
22. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VFK INVESTMENT L.L.C, Hiroba Games, and their directors, officers, employees, contractors, partners, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
your use or misuse of the Services
your violation of these Terms
your violation of applicable law
your infringement of any third-party rights
your unauthorized use of the Services
This obligation does not apply where prohibited by applicable consumer protection laws.
23. Consumer Rights
Nothing in these Terms is intended to limit any mandatory consumer rights that you may have under the laws of your country or region.
If applicable law gives you rights that cannot be waived, limited, or excluded, those rights will continue to apply.
24. Governing Law
These Terms and any dispute arising out of or related to the Services will be governed by the laws of the United Arab Emirates, without regard to conflict of law rules.
If you are a consumer, this choice of law will not deprive you of any mandatory consumer protections available under the laws of your country or region of residence.
25. Dispute Resolution
Before starting any formal legal proceeding, we encourage you to contact us at support@hirobagames.com so we can try to resolve the issue informally.
Any dispute arising out of or related to these Terms or the Services will be resolved by the competent courts of Dubai, United Arab Emirates, unless applicable law requires otherwise.
If you are a consumer, you may also have the right to bring a claim before the competent courts or consumer protection authorities in your country or region of residence, where required by applicable law.
26. Changes to These Terms
We may update these Terms from time to time.
If we make changes, we will update the 'Effective date' at the top of these Terms. Where required by law, we may provide additional notice, such as by displaying a notice in the Services.
Your continued use of the Services after the updated Terms become effective means that you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
27. Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent.
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, sale of assets, change of control, or by operation of law.
28. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remaining parts will remain in full force and effect.
29. No Waiver
Our failure to enforce any part of these Terms does not mean that we waive our right to enforce that part or any other part in the future.
30. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms that apply to specific features, purchases, events, platforms, or products, form the entire agreement between you and VFK INVESTMENT L.L.C regarding the Services.
